If I had this mare the curiosity would kill me, I'd have to do a DNA test.
I mean the sire could be a non-thoroughbred. Like a quarter horse or warmblood of some kind.

So I have a question, say someone booked a mare to a stallion,she got pregnant and she ended up in a kill pen. If a person saves her and they deliver the foal(especially if the person documents it and they know who the sire is) do they have to pay the stud fee or does the farm just eat that loss?

I would say the foal just wouldn't be registered. The stud farm doesn't have any obligation to release a service certificate if the stud fee isn't paid and without one the foal can't be registered. Perhaps the rescuer could work out a deal, pay the stud fee or whatever, with the stallion owner. Say they do, I think the bigger issue is (and I don't know the answer) does the JC allow someone to submit a live foal report and register a foal when they aren't the owner of record of the mare? The rescue is never going to get that mare's registration in their name unless the last owner on record switches it to them. And is someone who dumped their mare at a kill auction going to give a crap and switch it? Probably not.

She is! Just a gorgeous bay...and very protective. Did you see her lace her ears back and lower her head when her colt went just a bit too close to the other mare and foal? Mama Bear Mare.
